General Provisions

1. This Personal Data Privacy Policy (hereinafter referred to as “Privacy Policy”) is developed and applied by Sobha Realty, for the purpose of processing and protecting information about individuals who have submitted their personal data to Emerald City Properties, LLC (hereinafter referred to as “EmCity”), for processing (hereinafter referred to as “Users”), using services, information, services of the website located on the domain name https://villa-del-divos.net (hereinafter referred to as the “Site”).

2. This Privacy Policy defines the procedure and conditions of EmCity's processing of Users' personal data with and without the use of automation tools, establishes procedures aimed at preventing violations of the current legislation of the United Arab Emirates, eliminating the consequences of such violations related to the processing of personal data.

3. The Privacy Policy applies only to the Site, does not apply to any other sites, and does not apply to third party websites that may contain references to the Site and from which the Site may be linked. EmCity has no control over and is not responsible for any third party websites to which the User may link, available on the Site.

4. Use of the Site by the User means agreement with this Privacy Policy. In case of disagreement with the terms of the Privacy Policy, the User must stop using the Site. Solis Motor City by Sobha Realty has the right to make changes to this Privacy Policy at any time without notice to Users. The new version of the Privacy Policy shall come into force from the moment of its posting on the Site, unless otherwise expressly stated in the new version of the Privacy Policy. Use of the Site after the entry into force of the new version of the Privacy Policy Privacy Policy means that the User agrees with it and applies to it in full extent provisions of the new edition.

Applicable terms and legislation

1. Personal Data - any information relating directly or indirectly to a specific or identifiable natural person (User).

1. This Privacy Policy establishes EmCity's obligations on non-disclosure of Personal Data and ensuring the confidentiality of personal data that the User provides by filling out the form on the Site to order a consultation.

2. Personal data allowed to be processed within the framework of this Privacy Policy includes the following information: User's name; contact phone number and e-mail address (e-mail) of the User.

3. EmCity collects statistics about Users' IP addresses. This information is used to identify and solve technical problems of the Website and to identify spam.

4. Any other personal information not specified above (browsers and operating systems used, etc.) is subject to secure storage and non-disclosure.

Purposes of personal data collection

1. Providing the User with access to personalized resources of the Website.

2. Establishing feedback with the User, including sending notifications, inquiries regarding the use of the Site, provision of services, processing of requests and applications from the User.

3. Determining the list of the most recently viewed properties.

4. Providing the User with effective customer and technical support in case of problems related to the use of the Site.

6. Obtaining statistical and analytical data to improve the functioning of the Site and its services.

7. Confirmation of the accuracy and completeness of the Personal Data provided by the User when placing advertisements on the Site.

8. Creation of an account with the User's consent.

9. Identification of the User registered on the Website.

10. For other purposes if the relevant actions of EmCity do not contradict the Law, EmCity's activities, and the User's consent has been obtained for such processing.

Terms and methods of personal data processing

1. Processing of personal data is carried out without limitation of time, by any lawful means, including in personal data information systems with or without the use of means of automation. The User may at any time send to EmCity, indicated on the Website, an application for termination of Personal Data Processing. EmCity has the right to continue Processing of personal data without the User's consent only if there are grounds established by the Legislation.

2. User's personal data may be transferred by EmCity to authorized governmental authorities of the United Arab Emirates in accordance with the procedure and on the grounds established by the Legislation.

3. EmCity has the right to disclose the User's Personal Data, if their disclosure is necessary in connection with filing a lawsuit, complaint in order to protect the rights and legitimate interests of EmCity in relation to the User's misuse of the Site.

4. EmCity shall take the necessary organizational and technical measures to protect the User's Personal Data from unlawful or accidental access, destruction, modification, blocking, copying, distribution, as well as from other unlawful actions of third parties.

Measures to ensure the security of personal data during their processing

1. Internal control over compliance of Personal Data processing with the Law, this Privacy Policy and local acts of EmCity.

2. Familiarization of EmCity employees directly involved in personal data processing with the provisions of the Personal Data Protection Law, this Privacy Policy, other documents defining EmCity's policy on personal data processing and local acts on personal data processing issues; provision of training to the said employees.

3. Application of organizational and technical measures to ensure the security of Personal Data during their processing in personal data information systems, necessary to meet the requirements for their protection.

4. Exercising control over the measures taken to ensure personal data security and the level of protection of personal data information systems.

Final provisions

1. All EmCity employees authorized to handle Personal Data must familiarize themselves with this Privacy Policy prior to handling Personal Data.

2. All disputes arising within the framework of this Privacy Policy, by agreement of the User and EmCity shall be referred to the court at the location of Solis Motor City by Sobha Realty with observance of the pre-trial procedure of dispute settlement. The pre-trial procedure will be considered complied with after the party whose rights are violated receives the refusal of the other party from the proposal on the method of dispute settlement, or does not receive a response to this proposal within the period specified in it.

3. All matters not covered by this Privacy Policy shall be resolved in accordance with the Law.
